BIG WIN FOR Ms. MWENDE MWINZI, SOUTH KOREA ENVOY NOMINEE

It was all tears for the Petitioner Ms. Mwende Mwinzi, South Korea envoy nominee on thursday afternoon as the High court judge Justice Aaron Makau ruled that she cannot renounce her citizenship obtained by birth both in United States and in Kenya.

Justice Aaron Makau further ruled that an ambassador is not a state officer but a public officer and that it’s only State officers that are barred by the constitution from holding dual citizenship.

Justice Makau elaborated that nominee falls within the category of Article 78(3)(b), which exempts persons who has been made citizens of another country by operation of that country’s law, without the ability to opt out.
